CUTX Text Message (SMS) Service Terms of Use
PLEASE READ THE FOLLOWING CUTX TEXT MESSAGING (SMS WIRELESS) TERMS AND CONDITIONS. YOU AGREE TO ABIDE BY AND BE BOUND TO THESE INFORMATIONAL AND MARKETING TEXT MESSAGING TERMS AND CONDITIONS.
In this Agreement, the words “You,” and “Your” mean any and all persons or entities who sign a Membership Application or any other application in connection with the opening of any Account with Credit Union of Texas. The words “we,” “us,” “our,” and “CUTX” mean Credit Union of Texas.
By texting “Yes” and opting-in to receive text messages from CUTX Text Messaging (SMS Wireless) (the “Service”), You agree to the following terms and conditions:
a. You consent to receive text messages from CUTX, its affiliates, or any party texting on its behalf. The text messages you receive may contain special offers or referencing products and services we think might be useful to you. These text messages will be delivered to you using an automated dialing system. You agree to receive these text messages at the number of the phone that you used to opt-in, which you own or are authorized to provide. Your consent to receive these automated text messages is not a condition of receiving any CUTX product or service. You may revoke your consent at any time.
b. You understand and consent the number of CUTX text messages that you receive will vary depending on the CUTX text messaging campaign for which you sign up to receive messages, and the frequency of the messages sent by those campaigns.
c. You agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, costs and expenses (including reasonable attorneys’ fees) arising from your provision of a phone number that is not your own or your violation of applicable federal, state or local law, regulation or ordinance. You agree that any action, dispute, claim, or controversy of any nature between you and CUTX arising from or related to a CUTX text messaging program will be subject to and resolved in accordance with the BINDING ARBITRATION CONSENT AND AGREEMENT terms and conditions outlined in your CUTX Account Agreement or CUTX Business Membership and Account Agreement.
d. You understand and acknowledge the text messages we send may be seen by anyone with access to your phone. You agree to protect your communications device and not to let any unauthorized person have access to the information we provide to you.
e. You represent that you are the account holder for the mobile telephone number(s) that you have
designated as your cell phone on your CUTX membership. You are responsible for notifying CUTX immediately if you change your mobile telephone number. You may notify CUTX of a number change by contacting CUTX Member Services at 214-818-3231 or 800-627-0006. You understand and agree to indemnify CUTX in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify CUTX if you change your telephone number including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
f. You understand and agree it is your responsibility to determine if your mobile carrier supports text messaging and if your mobile device is capable of receiving text messages. Your receipt of our text messages is subject to the terms and conditions of your agreement(s) with your mobile carrier.
g. CUTX makes no warranty regarding availability or reliability of the Service and CUTX shall have no liability related to any delay or failure in the delivery or receipt of messages from the Service.
h. CUTX may change these terms and conditions at any time. Updated terms and conditions shall be effective when posted to CUTX’s website. You agree to review the terms and conditions regularly to ensure you are aware of any changes. Your continued use of the Service after the terms and conditions have been changed shall constitute your acceptance of the new terms and conditions.
i. CUTX may cancel your subscription to the Service at any time without notice to you.
j. Depending on your relationship with CUTX, the terms of other agreements may apply to your use of the Service. At a minimum, use of the Service by CUTX members shall be subject to the terms of the CUTX Account Agreement or CUTX Business Membership and Account Agreement.
k. CUTX values your privacy. You may read about CUTX’s Privacy Policy at https://www.cutx.org/privacy-policy.
How to Opt-In
To opt-in to a CUTX text messaging program(s), please follow the instructions provided by the specific program from which you wish to receive messages. Reply as indicated in an initial text message.
How to Opt-Out
To revoke your consent from marketing text messaging programs at any time, text “STOP” in response to the message received. For help or further information text “HELP.”
a. To stop receiving text messages from a specific CUTX marketing and promotional text messaging program, text STOP to 214-818-3231 for the marketing and promotional text messaging program from which you no longer wish to receive messages. You acknowledge that you will then receive one (1) final message from CUTX confirming your opt-out of that marketing and promotional text messaging program. Following such confirmation message, no additional marketing and promotional text messages associated with that program will be sent to you unless you re-activate your subscription. This will only opt you out of the specific marketing and promotional text messaging program. You acknowledge that you will remain opted in to other CUTX text messaging programs.
b. To stop receiving text messages from ALL CUTX text messaging programs, text “STOPALL” to 214-818-3231. You acknowledge that you will then receive one (1) final message from CUTX confirming your opt-out of ALL CUTX text messaging programs. Following such confirmation message, no additional text messages associated with any program will be sent to you unless you opt into a specific program from which you wish to receive messages. This will not opt you out of Online Banking automated alerts. Please visit www.cutx.org or Online Banking via the Mobile App to deactivate automated alerts or text STOP to 214-818-3231 for the text messaging alert from which you no longer wish to receive messages.
CUTX Payment Reminder Program
For CUTX active loan participants, you will receive up to three (3) payment reminders each month via text message for each one of your CUTX loan/lease accounts. The first payment reminder will be sent out five (5) days before your loan payment is due, the second payment reminder will be sent out the day your loan payment is due, and a third payment reminder will be sent if you are ten (10) days past due on your loan payment. Reply “HELP” for help, “NO” to Cancel Payment Reminders on one account and “ALL” to Cancel Payment Reminders on all accounts. Message and data rates may apply.
Access or Delivery to Mobile Network is Not Guaranteed
Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of CUTX’s control, and CUTX is not responsible or liable for issues arising from such network services (e.g., delayed or undelivered messages or the security of any messages).
Supported Carriers
Supported carriers may change from time to time. Current participating carriers include AT&T, Verizon, T-Mobile, and Sprint.
Fees
CUTX charges no fee for the Service, but your cellular carrier’s message and data rates may apply to our initial text message and all subsequent text messages.
Security
Text messages are not encrypted. Do not attempt to send sensitive information via text messaging. CUTX will never ask that you send us sensitive information via text message. If you receive a text message purported to be from CUTX and requesting sensitive information, please do not respond and contact CUTX immediately by phone at 214-818-3231 during regular business hours or 800-627-0006 during or after regular business hours.
